Having an employee handbook is critical to a company and having it updated with all the necessary policies is crucial. Labor research has proven that Employers have a delay in implementing new regulations and adding them to Employee Handbooks or stand-alone policies. 

New regulations go hand in hand with the employee handbook and standalone policy updates. As a compliance officer, I am always providing support to Employers and professionals and seeing what the gaps are when protecting employees. Federal, State, and local regulations have an impact on maintaining workplace compliance and Employers need to be aware that when Federal, State, and Local regulations clash the regulations with the most benefit for the employees supersede.

Here is the Department of Homeland Security (DHS Goes Again)! They have decided to update the I-9 Form for 2022. We know that when updates happen Employers and Professionals scramble to understand how the changes will impact the I-9 form process. At this time (as previously done) DHS will have a public comment period sponsored by the Federal Register. The deadline for this comment period is May 31, 2022.

Employers, professionals, Employment law firms, employees, and anyone who has an interest in providing feedback can provide feedback.

Used by all employers, Form I-9 has always had many traps for the unwary. DHS, with its proposed changes, is trying to simplify and clarify things. There might be some effective changes like reducing the number of pages in the instruction document and other changes that should help the process.

The proposed changes include:

Paper reduction.

  • DHS is compressing Sections 1 and 2 into one page instead of two.
  • Section 3 will be a separate Reverification and Rehire Supplement that is a "stand-alone" section, which only is accessed if needed for one of those purposes.
  • The instructions which are attached to Form I-9 are reduced from 15 pages to 7, and users are directed to the online M-274 handbook and I-9 Central for all other questions.

 

Clarifications

  • The new I-9 places more emphasis on what constitutes discrimination in the I-9 context.
  • There will be clarified verification and rehire instructions directly on the form.
  • The onerous "N/A" requirement is eliminated by clarifying that fields that do not apply can be left blank.

 

There are other changes that will require some getting used to when it comes to  List C Documents and details about the effective date of using the form when it has been ready for use.
